The Third Liberalisation Package: Towards an Agreement



At the last Energy Council held on 28 February, the Presidency concluded that the Ministers had the shared intention of reaching a political agreement on the third liberalisation package at the Energy Council that will take place on June 6th. The EU's Heads of State at the European Council endorsed this aim. Two days prior to the June Energy Council, the European Parliament will vote its formal opinion on the Commission's proposals, leaving the way clearly open to an agreement on the 6th.

Recent events had given a further impetus to reaching an agreement in June, including the competition law settlement with E.ON leading to ownership unbundling and the Commission's new "non-paper" outlining a further possible alternative on unbundling. Further competition policy developments in other cases being investigated by the Commission's DG Competition were also expected before June.

This major conference was therefore more than timely. It gave the first opportunity to hear from key Commission Officials, Energy Regulators and industry after the Council, to get a real understanding of the consequences of the decisions taken, the agreements reached. It will enable delegates to learn from key European Parliament figures on how they expect the next stage of the negotiations to develop.

Competition policy and the energy sector: training day / seminar



In response to interest from our clients, and to mark the publication of the Second Edition of our publication on EU Competition Law and Energy Markets, we organised a one-day training event and seminar on competition policy and the energy sector.

This training day was designed for company representatives wishing to gain a working knowledge of this issue, of increasing importance in their day-to-day work, as evidenced by the Commission’s recent announcement of the opening of proceedings against ENI and RWE. The Course was given, inter alia, by Professors Marc van der Woude and Leigh Hancher, together with Christopher Jones, Emmanuel Cabau and Lars Kjolbye from the European Commission plus a number of additional guest speakers.
